1. Scope

These Terms and Conditions apply to the use of the "Habbly" app and the associated website habbly.de (together "Habbly"), offered by Ralf Freit, Tannenstr. 25, 26844 Jemgum, Germany (see Legal Notice). They apply to all users, regardless of whether the free or the paid Premium version is used.

2. Description of services

Habbly is a playful task-management app for families. Adult household members can create tasks, assign them to children, and confirm their completion; progress is represented through experience points, levels, virtual coins, and rewards. Habbly does not provide any financial service: an "allowance" balance kept within the app is a purely bookkeeping feature within the app — actual payment of real money to children remains solely the responsibility of the parents/legal guardians.

3. Registration & account

An account is required to use the full functionality. Parents/legal guardians can additionally create managed profiles for children without their own email address; responsibility for these profiles remains with the parents/legal guardians. Access credentials (password, parent PIN) must be kept confidential.

4. Free use & Premium subscription

Habbly is available in a free version with limited functionality (including the display of advertising, a limited number of households/members) as well as a paid Premium subscription. Premium subscriptions are exclusively concluded, managed, and billed through the Apple App Store or Google Play. Current prices and terms:

New users are offered a one-time, 14-day free trial with full functionality. The trial does not automatically convert into a paid subscription.

5. Contracting party for payment processing

The purchase itself (charge, payment method, invoicing) takes place exclusively between you and Apple or Google; their respective terms of use apply in addition. We do not receive complete payment data. To unlock Premium features, the app sends the purchase receipt issued by Apple/Google to our server, which verifies it directly with Apple or Google.

6. Term, automatic renewal & cancellation

Premium subscriptions automatically renew for the selected term unless cancelled in good time before expiry. Cancellation takes place exclusively through the subscription management of the respective app store (not through Habbly itself) — details can be found in the help pages of Apple or Google. After cancellation, Premium remains active until the end of the already paid term.

7. Right of withdrawal

8. User obligations

When using Habbly, name fields in particular (display name, child profiles, room/set titles) must be kept free of offensive, discriminatory, or unlawful content. We reserve the right to remove such content and to suspend accounts in case of repeated violations.

9. Liability

We are liable without limitation for intent and gross negligence, as well as under the Product Liability Act. For slight negligence, we are only liable for breach of material contractual obligations (cardinal obligations) and limited to the damage typically foreseeable for this type of contract. We assume no liability for the actual payment of the purely informational "allowance" balance kept within the app — this is the sole responsibility of the parents/legal guardians.

10. Changes to these Terms

We may change these Terms with effect for the future to the extent necessary to adapt to changes in law, case law, or the app's functionality. We will inform you of material changes in the app or by email.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should any provision of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
